Art. 1 – Shipping Address and Liability
The Seller ships the Products exclusively to the address provided by the Buyer. The Buyer is solely responsible for the accuracy of the details provided. The Seller accepts no liability (including any ancillary custody charges) for failed deliveries attributable to incorrect or incomplete addresses.
Art. 2 – Processing Times
Unless otherwise expressly agreed between the parties (for example, in the case of purchases of “Pre-order” items or “Mixed Orders”, or for the “Custody” service), the Seller undertakes to deliver the goods to the Customer without undue delay and, in any case, no later than 30 days from the date on which the contract is concluded. However, the Seller cannot be held liable for any delays or disruptions in delivery not directly attributable to its own negligence, such as delays caused by the courier, strikes, adverse weather conditions or other causes of force majeure.
2.1 Transfer of Risk: Pursuant to Article 63 of the Italian Consumer Code, for buyers who qualify as Consumers, the risk of loss of or damage to the goods, for reasons not attributable to the Seller, remains with the Seller exclusively until the moment of delivery. The risk passes definitively to the Customer at the moment when the Customer (or a third party designated by the Customer, other than the carrier) takes physical possession of the goods.
Art. 3 – Handling of “Mixed Orders” (In-stock + Pre-order Products)
Where an order contains both Products available in stock and “Pre-order” Products, the order will be dispatched in a single shipment only once all the products are physically available. To receive the available products straight away, you must place separate orders or contact us ([email protected] / WhatsApp 3299570567) to arrange a split shipment with an additional charge.
Art. 4 – Inspection upon Receipt (Conditional Acceptance)
Upon receipt, the Buyer must inspect the packaging. In the event of any anomalies, crushing or tampering, the Buyer is required to:
- Sign the courier’s receipt adding the wording “Accepted subject to specific inspection” (e.g. “crushed parcel”).
- Report the incident within 48 hours to [email protected], attaching clear photographic evidence of the outside of the parcel, the label and the damage. Note: For high-value shipments, the Seller archives photographic/video records of the packing stage as anti-tampering evidence.
Art. 5 – Failed Delivery and Custody at the Courier
The Customer will receive a tracking number and is required to be available to receive the parcel. If the Customer is absent, the courier will place the parcel in custody, which the Customer must arrange to release. Should the parcel be returned to the sender (RTS – Return to Sender), the return and re-shipping costs will be borne entirely by the Customer. If the Customer does not pay these costs within 15 days of notification:
- Standard Products: The order will be refunded minus the shipping costs (outbound and return) and a handling penalty of €10.00.
- Products opened during a “Live”: The contract shall be deemed terminated. The Seller will retain the goods and the sums paid as a penalty for non-performance.
Art. 6 – Custody Service
6.1 Activation and Limits: The Seller offers an optional custody service that allows multiple orders to be combined. It is free of charge for a maximum of 60 consecutive days from the first order placed in custody.
6.2 Release: The Customer may release the stored items by paying the corresponding shipping costs
6.3 Expiry and Non-performance: Once the 60 days have elapsed, the Seller will send a notice via WhatsApp and/or email. If the Customer does not pay the shipping costs within 7 days of the notice, the Seller shall be released, at its sole and unquestionable discretion, from the custody obligation: it will acquire ownership of the goods as a penalty and retain the sums paid, with no obligation to refund.
6.4 Liability: During the custody period, the Seller acts as a gratuitous bailee and undertakes to keep the goods with the utmost diligence (sleeves, toploaders, display cases), storing them in dedicated secure areas to safeguard their integrity. Except in cases of wilful misconduct or gross negligence, liability for the loss of goods in custody is limited to the most recent minimum valuation on the Cardmarket portal.
Art 7. Pre-Shipment Documentation and Anti-Tampering Seals
For shipments containing high-value single cards or valuable boxes, the Seller reserves the right to make and archive a video recording and/or a detailed photographic record of the product and of the packing stages (up to the final sealing of the parcel with custom-branded or anti-tamper tape). Such documentation shall serve as evidence in the event of fraudulent claims concerning alleged missing items inside the parcel or alleged damage not attributable to transport.
