Art. 1 – The Right of Withdrawal
Pursuant to art. 52 of the Italian Consumer Code, if the Buyer is a Consumer, they have the right to withdraw from the contract without giving any reason within 14 days of physically receiving the products. The right of withdrawal does not apply to purchases made by professionals with a VAT number.
Art. 2 – Exclusions from the Right of Withdrawal
Given the particular nature of the trading card game (TCG) market, the right of withdrawal is strictly forfeited in the following cases:
A) Tampered Sealed Products: Pursuant to art. 59, letter e) of the Italian Consumer Code, withdrawal is excluded for Booster Boxes, Elite Trainer Boxes, booster packs and similar products where the original seal (shrink-wrap or cellophane) has been removed, opened or altered by the customer.
B) “Live Opening” Service (Pack Opening): By explicitly requesting the “Open LIVE” service at the time of purchase, the Customer requests that performance of the service begin before the 14-day period expires. Consequently, pursuant to art. 59, paragraph 1, letters a) and e) of the Italian Consumer Code, the Customer unequivocally loses the right of withdrawal as soon as the Seller removes the seal live. Opened products (both rare and common cards) cannot in any way be returned or refunded.
Art. 3 – How to Make a Return
To exercise the right of withdrawal on eligible goods (sealed and untouched), the Buyer must send an explicit notice within the 14 days to the email address [email protected] (or via certified email (PEC)). The Buyer must return the goods, at their own expense and responsibility, to the premises of La Cantina Dello Sbusto S.R.L., Via Fratelli Friggeri 8, 42010 Rio Saliceto (RE). The goods must be carefully packed to prevent damage during transport.
Art. 4 – Refunds
If the right of withdrawal is exercised in accordance with these provisions, the Seller will refund the amount paid for the Products (including the initial standard shipping costs) within 14 days of receiving the returned goods at its warehouse, using the same payment method chosen by the Buyer. In the case of payments in cryptocurrencies, the refund will be made under the conversion conditions specified in Art. 4.5 of the Terms and Conditions.
Art. 5 – Legal Guarantee and Defects
For Consumers, the conformity of goods is guaranteed for 24 months. Substantial discrepancies from the product purchased (e.g. receiving a different box) are considered defects. The following do not constitute a lack of conformity:
- The random and unfavourable outcome of the contents of booster packs (the odds are set by the manufacturer).
- Minor cosmetic imperfections of the packaging or of individual cards (print lines, miscut, whitening on the edges), as these are inherent production and printing defects of the manufacturer and are not attributable to the Seller.
